{"id":267,"date":"2020-04-28T06:38:28","date_gmt":"2020-04-28T06:38:28","guid":{"rendered":"https:\/\/rkmc.co.in\/blog\/?p=267"},"modified":"2020-04-28T06:38:31","modified_gmt":"2020-04-28T06:38:31","slug":"prevention-of-sexual-harassment-at-workplace-a","status":"publish","type":"post","link":"https:\/\/rkmc.co.in\/blog\/prevention-of-sexual-harassment-at-workplace-a\/","title":{"rendered":"Prevention of Sexual Harassment at Workplace Act(POSH)"},"content":{"rendered":"\n<p>In order to make a safer working environment for women and for <strong>prevention of sexual harassment at workplace<\/strong> a law was passed by the Ministry of Women and Child Welfare in 2013.<\/p>\n\n\n\n<p>The law is known as Sexual Harassment of Women at Workplace(prevention, Prohibition and Redressal) 2013 also know as the <strong><a href=\"https:\/\/www.rkmanagementconsultant.com\/sexual-harassment-workshop.html\">POSH<\/a><\/strong> act. The law is applicable to all workplaces, establishment, companies,shop,restaurant etc with 10 or more than 10 employees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is considered as Sexual Harassment in Workplace?<\/h2>\n\n\n\n<p>The following unwelcome behaviour whether directly or indirectly will be considered as <strong>&#8220;Sexual Harassment&#8221;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Any type of physical contact and advances.<\/li><li>Demand or request for any kind of sexual favours<\/li><li>Making any sexual remarks about person&#8217;s clothing or body<\/li><li>Showing of pornography<\/li><li>Any other form of verbal, non-verbal, visual or physical sexual conduct.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Compliances of Sexual Harassment Bill or POSH Act<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Committee<\/strong> &#8211; Each organisation with 10 or more employees is required to form a internal complain committee with head as female presiding officer.<\/li><li><strong>Policy<\/strong> &#8211; Phrasing a internal POSH policy for<strong> prevention of sexual harassment at workplace<\/strong>.<\/li><li><strong>Training Programme<\/strong> &#8211; <a href=\"https:\/\/www.rkmanagementconsultant.com\/what-is-sexual-harassment.html\">Training programmes<\/a> and orientations are also required to be carried out to increase awareness.<\/li><li><strong>Annual Report<\/strong> &#8211; The organistion is also required to submit a annual report disclosing the number of complaints received and number of complaints disposed and cases pending for more than 90 days.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Penalties on failure<\/h2>\n\n\n\n<p>There are heavy penalties on failure to follow the POSH act. Some of the <a href=\"https:\/\/rkmc.co.in\/blog\/rk-management-consultant-rkmc-legal-service-provider-in-gurgaon\/\">provisions<\/a> under this act are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li> Fine of INR-50,000 on  breaching the provisons or any rules under this or in case of  inefficiency to form a internal committee.<\/li><li>On commiting same offence twice in a row under this act the punishment will be <strong>double<\/strong>.<\/li><li><strong>Cancellation<\/strong> of  <strong>withdrawal<\/strong> of his license.<\/li><li><strong>Non-renewal<\/strong> or <strong>cancellation of
